Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
- Consumer: any natural person not acting in the course of a business or profession who enters into a distance contract with the entrepreneur.
- Day: a calendar day.
- Long-term contract: a distance contract relating to a series of products and/or services whose delivery obligations extend over a period of time.
- Durable data carrier: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
- Right of withdrawal: the consumer’s option to cancel the distance contract within the cooling-off period.
- Model form: the standard withdrawal form provided by the entrepreneur, which consumers may use when exercising their right of withdrawal.
- Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance — CraftBrew.nl.
- Distance contract: an agreement concluded within a system organised by the entrepreneur for selling products and/or services remotely, using exclusively distance communication methods.
- Distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being physically present together.
- Terms & Conditions: these General Terms & Conditions of the entrepreneur.

Article 3 – Applicability
- These Terms & Conditions apply to all offers, orders, and distance contracts between the entrepreneur and consumers.
- Before concluding a distance contract, the consumer receives access to these Terms & Conditions. If providing them in advance is not reasonably possible, CraftBrew.nl will inform the consumer where the Terms can be reviewed and will send them upon request, free of charge.
- If the contract is concluded electronically, the Terms & Conditions may be supplied electronically in a format that allows the consumer to store them on a durable data carrier.
- If additional product-specific terms apply, those shall apply alongside these Terms. In case of conflict, the consumer may rely on the provision most favourable to them.
- If any clause in these Terms is invalid or annulled, the remaining provisions remain fully applicable. The invalid clause will be replaced with one that matches the original intent as closely as possible.
- Situations not covered by these Terms shall be interpreted in the spirit of these Terms.
Article 4 – The Offer
- If an offer is valid for a limited time or subject to conditions, this will be stated clearly.
- All offers are non-binding. CraftBrew.nl may adjust or withdraw offers at any time.
- Product descriptions are complete and accurate enough to allow proper assessment by the consumer. Images represent the products truthfully; however, colour variations may occur depending on screen settings.
- Obvious mistakes or errors do not bind the entrepreneur.
- Each offer clearly specifies:
- the total price including VAT
- any applicable shipping costs
- how the agreement is formed
- whether the right of withdrawal applies
- method of payment, delivery, and execution
- validity period of the offer
- whether the contract will be stored and accessible
- the technical steps to identify and correct input errors
- available contract languages
- any relevant codes of conduct
- the minimum duration of long-term agreements
Article 5 – The Agreement
- The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
- When an order is placed electronically, CraftBrew.nl will confirm receipt electronically. Until confirmation is sent, the consumer may cancel the order.
- CraftBrew.nl takes appropriate technical and organisational measures to protect all electronic data transfers and provide a secure shopping environment.
- The entrepreneur may assess whether a consumer can meet their payment obligations. If there is justified reason, the entrepreneur may refuse an order or attach special conditions.
- Upon delivery of the product, the consumer will receive:
- company contact details
- instructions regarding the right of withdrawal (or indication of exclusion)
- warranty and after-sales information
- a copy of these Terms (unless already provided)
- Every agreement is made under the condition of product availability.
Article 6 – Right of Withdrawal
- Consumers may return products within 14 days of receiving them, without giving any reason.
- During the cooling-off period, the consumer must handle the product and packaging carefully and only inspect it as reasonably necessary.
- If exercising the right of withdrawal, the product must be returned with all accessories and, if possible, in the original packaging.
- The consumer must notify CraftBrew.nl of the withdrawal within 14 days of receipt — using the model form or any other clear written statement.
- After notification, the consumer must return the product within 14 days.
- If the consumer does not comply with the deadlines above, the purchase becomes final.
Article 7 – Costs in Case of Withdrawal
- Only the direct return shipping costs are borne by the consumer.
- If the consumer has paid any amount, CraftBrew.nl will refund it within 14 days after withdrawal, provided the returned goods have been received or sufficient proof of return has been supplied.
- Refunds are processed via the same payment method used for the purchase, unless otherwise agreed.
- If a product is returned damaged due to misuse, the consumer is responsible for any loss in value.
- Consumers cannot be charged for diminished value if CraftBrew.nl did not provide mandatory withdrawal information before purchase.
Article 8 – Exclusions from the Right of Withdrawal
The right of withdrawal may be excluded for products that:
- are made to the consumer’s specifications;
- are clearly personal in nature;
- cannot be returned due to their nature;
- can spoil or age rapidly (e.g., certain food-grade products);
- are sealed for hygiene reasons, and the seal has been broken;
- involve audio/video/software with a broken seal.
CraftBrew.nl will clearly indicate any exclusions in the product offer.
Article 9 – Pricing
- Prices will not be increased during the validity period of an offer, except due to VAT changes.
- Products subject to market fluctuations (e.g., grain prices) may be offered with variable pricing.
- Price increases within three months after purchase are only allowed if legally required.
- All product prices include VAT.
- Typographical or pricing errors do not bind CraftBrew.nl.
Article 10 – Conformity & Warranty
- CraftBrew.nl guarantees that delivered products meet the agreement, specifications stated in the offer, and reasonable expectations of quality and usability.
- Any manufacturer warranties apply in addition to consumer rights under Dutch law.
- Consumers must report defects within two months of discovery.
- Warranty does not apply if:
- the consumer has modified or repaired products themselves;
- the product was used improperly or stored incorrectly;
- damage results from external conditions not attributable to CraftBrew.nl.
Article 11 – Delivery & Execution
- CraftBrew.nl handles orders with care and aims to dispatch them promptly.
- Delivery takes place at the address provided by the consumer.
- Delivery will take place within 30 days unless otherwise agreed. If a delay occurs, the consumer may cancel the contract without cost.
- Delivery times are always indicative and non-binding.
- If an item is unavailable, CraftBrew.nl may deliver a replacement product, clearly stating this upon delivery. Consumers may return replacement items under the same conditions as regular orders.
- The risk of damage or loss rests with CraftBrew.nl until delivery.
Article 12 – Long-Term Agreements: Duration, Termination & Renewal
- Consumers may terminate an indefinite contract with one month’s notice.
- Fixed-term contracts may be terminated at the end of the term with one month’s notice.
- Automatic renewal for fixed-term contracts is not permitted unless explicitly allowed by law (e.g., newspaper subscriptions).
- Agreements lasting longer than one year may be cancelled after one year with one month’s notice.
Article 13 – Payment
- Unless otherwise agreed, payments must be made within 7 working days after the start of the cooling-off period.
- Consumers must notify CraftBrew.nl of any incorrect payment details immediately.
- If payment is not made on time, the entrepreneur may charge reasonable collection costs.
Article 14 – Complaints Procedure
- The entrepreneur has a sufficiently well-known complaints procedure and handles the complaint in accordance with this complaints procedure.
- Complaints about the performance of the agreement must be submitted to the entrepreneur fully and clearly described within 2 months after the consumer has discovered the defects.
- Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.
- If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure.

For complaints, a consumer should first turn to the entrepreneur. If the online store is affiliated with ValuedShops and complaints cannot be resolved by mutual agreement, the consumer should turn to ValuedShops (www.valuedshops.com), which will mediate free of charge. Check whether this store has a current membership through www.valuedshops.com/members. If there is still no solution, the consumer has the possibility to have his complaint handled by the independent arbitration board appointed by ValuedShops, the decision is binding and both entrepreneur and consumer agree to this binding decision. To submit a dispute to this dispute committee are costs associated that the consumer has to pay to the committee.
Article 15 – Disputes
All agreements between CraftBrew.nl and the consumer are governed exclusively by Dutch law.
The Vienna Sales Convention does not apply.
Article 16 – Additional Provisions
Any additional or deviating provisions must not disadvantage the consumer and must be recorded in writing or stored on a durable data carrier accessible to the consumer.
